Taita Juan is Free!

As of November 16, 2010, the criminal charges against Taita Juan have been dropped. Within the next couple of days, the court will begin the process of transferring Taita Juan out of prison to the immigration authorities who will make arrangements for his return to Colombia.

On Tuesday, October 19, 2010, the Indigenous Colombian healer was detained in the Houston International Airport. He was formally arrested by ICE (Immigration and Customs Enforcement) for possession of his traditional medicine Ayahuasca.

Taita Juan Agreda Chindoy is an indigenous Cametsa traditional healer from the Sibundoy Valley in the Alto Putumayo of Colombia. In addition to being recognized by the Colombian Ministry of Health, he is a recognized lineage holder of traditional Amazonian medicine and an established healer and leader in his community.

According to a report from Caracol Radio, one of the main radio networks in Colombia,”a Federal Court ruled his release when his attorney showed that Yage (ayahuasca) is a medicinal plant used by indigenous as traditional medicine, and does not generate dependency”.

Among Agreda’s legal defense team is Nancy Hollander. Nancy was the lead attorney that was successful before the Supreme Court in granting the UDV church legal authorization for the religious use of ayahuasca.

Support came from around the world as many people came to Juan’s side, both physically and spiritually, including reports that Colombian embassy officials visited Juan last week, reportedly offering their support. Indigenous rights groups, human rights organizations and networks of the vast ayahuasca community are also among those who came to his aid.

More than €1800 gathered from fundraising initiatives in Europe has been presented to Juan’s family who are “overwhelmed with joy”. The Free Taita Juan campaign raised over $14,000 for his legal defense.

  1. I’m not sure this story is true. I’ve contacted the listed organization of the donations through Pay Pal which is a company called Eco Era – http://ecoera.org/home.html and I am awaiting their response.
    There is no mention of the this story or campaign on their site, so it makes me wonder….
    I have also checked all the Houston newspapers for any mention of this story and there isn’t one mention.
    Do you have independent verification of the story?

    The Free Taita Website asks for donations, yes, but also testimonials which would aid in building a strong case. Here is the wording:

    Provide testimonials to support Taita’s case. We are collecting written testimonials from individuals who have experienced Taita’s medicine. Testimonials should tell about your experience with Taita within the religious and spiritual context of the Ayahuasca ceremonies. Compelling testimonials will help us build the case that Ayahuasca is a spiritual and religious experience that facilitates a profound healing and not a recreational drug experience. These testimonials will also be presented to the prosecutor to build a case for dismissal. Testimonials can be emailed to contact@freetaitajuan.org.

    In my opinion Taita Juan should not have been imprisoned. Ayahuasca is not only used for medicine, but it is also used for religious purposes. He should be protected by the First Ammendment to possess Ayahuasca, under the Freedom of Religion, AND the Religious Freedom Restoration Act of 1993. I suggest that you gather as much information and evidence that you can to fully back-up the fact that Taita Juan has the RIGHT to possess the holy medicine, and spiritually enhancing, Ayahuasca. And I hope that very soon Taita Juan will be set free.

    Em 21 de fevereiro de 2006, o Presidente da Suprema Corte dos EUA, John Roberts, declarou na sentença que garantiu aos filiados do Centro naquele país a livre comunhão do chá Hoasca nos rituais religiosos da União do Vegetal: O Centro Espírita Beneficente União do Vegetal (UDV) é uma seita Espírita Cristã com Sede no Brasil, com uma filial americana de aproximadamente 130 pessoas. É essencial à fé da UDV receber a comunhão através da Hoasca, um chá sacramental preparado a partir de duas plantas nativas da região amazônica. Uma das plantas, Psychotria viridis, contém Dimetiltriptamina (DMT), um alucinógeno cujos efeitos são realçados por alcalóides de outra planta, Banisteriopsis caapi. O DMT, assim como “qualquer material, composto, mistura, ou preparado que contenha qualquer quantidade de [DMT]” faz parte da lista da Escala I do Ato de Substâncias Controladas. O Governo argumenta que, o fato de as substâncias da Escala I do Ato de Controle de Substâncias terem um “alto risco de abuso, não serem aceitas, atualmente, em uso médico nos tratamentos nos Estados Unidos, e pela falta de segurança que possibilite o uso sob supervisão médica, por si impossibilita qualquer consideração de exceções individualizadas, como a visualizada pela UDV. O Governo continua argumentando que o método regulamentar estabelecido pelo Ato é um sistema “fechado” que proíbe todos os usos de substâncias controladas, exceto as autorizadas pelo próprio Ato. De acordo com o Governo, não teria como acobertar exceções religiosas, uma vez reconhecidas, e o “público interpretaria erroneamente” tais exceções, entendendo que a substância em foco não seria prejudicial de maneira alguma. O RFRA, e o teste extremamente minucioso que adota, contempla um interrogatório mais focado que a abordagem categórica do Governo. O RFRA requer que o Governo demonstre que o teste de interesse inegável seja cumprido através da aplicação da lei em questionamento ‘à pessoa’, o reclamante em particular cujo exercício sincero da religião esteja sendo substancialmente oprimido. Na verdade, uma exceção foi feita quanto à proibição da Escala I para uso religioso. Nos últimos 35 anos, tem havido uma isenção regulamentada para o uso do Peiote, ‘uma substância da Escala I’, pela Igreja Nativa Americana. Em 1994, o Congresso estendeu aquela isenção a todos os membros de qualquer Tribo Indígena reconhecida. Tudo que o Governo diz sobre o DMT na hoasca (que, ‘como uma substância da Escala I, o Congresso já determinou que ‘tem um alto potencial de abuso,’, não tem no momento aceitação para uso médico’ e apresenta ‘uma ausência de segurança aceitável para seu uso… sob supervisão médica) se aplica em igual medida à mescalina no Peiote, e apesar disso, ambos, o Executivo e o Congresso decretaram, eles próprios, uma isenção do Ato de Controle de Substâncias para o uso religioso do Peiote pelos Nativos Americanos. Se tal uso é permitido perante a opinião congressional para centenas de milhares de Nativos Americanos que praticam sua fé, é difícil se ver como aquela mesma opinião possa excluir qualquer consideração quanto a uma isenção semelhante para os aproximadamente 130 membros americanos da UDV que querem praticar a deles.
